General Overview of the Information Request

1. INFORMATION ABOUT THE APPLICATION

In Article 11 of the Law on the Protection of Personal Data No. 6698, the rights of the data owner are stipulated. In the law, the data owner is deemed to be a “relevant person” and the right to make certain requests regarding the processing of the data is foreseen. Pursuant to this article, the claim rights of the person concerned are as follows:

  • a) Learning whether personal data is processed or not,
  • b) If personal data has been processed, requesting information about it,
  • c) Learning the purpose of processing personal data and whether they are used in accordance with its purpose,
  • ç) Knowing the third parties to whom personal data is transferred at home or abroad,
  • d) Requesting correction of personal data in case of incomplete or incorrect processing,
  • e) Requesting the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the law titled “Deletion, destruction or anonymization of personal data”,
  • f) Requesting the notification of the third parties to whom personal data has been transferred, that the incomplete or incorrectly processed data has been corrected or that the data has been deleted or destroyed upon the request of the person concerned,
  • g) Objecting to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems,
  • h) To request the compensation of the damage in case of loss due to the unlawful processing of personal data.

Applications must be submitted personally by the relevant data subject. No application may be made to request information regarding the personal data of another individual. MOMENTO LEGAL PARTNERS (hereinafter referred to as “MOMENTO” or the “Company”) may request additional information from the applicant for the purpose of verifying his/her identity where there is reasonable doubt as to the identity of the applicant.

If MOMENTO determines that a request has been submitted on behalf of another person without proper authorization, MOMENTO expressly reserves all rights and remedies available to it under the applicable laws, including the right to initiate any legal proceedings and assert any claims arising therefrom.

2. INFORMATION ABOUT THE APPLICATION PROCEDURE

You can send your requests regarding your rights mentioned above to MOMENTO, which is the data controller, in writing or by using the registered electronic mail (KEP) address, secure electronic signature, mobile signature or the e-mail address previously notified to the data controller by the person concerned and registered in the data controller's system. For applications to be made in writing, it is possible to apply by printing out the “Information Request Form”, which you can download by clicking the attachment. When this form is sent to our company, it should be placed in an envelope and “Information Request Regarding Personal Data” should be written on it. The application form;

1-With the application of the person concerned;

2-By registered mail with return receipt;

3-Via notary public;

3. INFORMATION REGARDING THE RELATED PERSON REQUESTING INFORMATION

If the name, surname and application are written in the information request you have sent to us, the signature, Turkish ID number, nationality for foreigners, passport number or identification number, if any, place of residence or workplace address for notification, e-mail address for notification, telephone and fax number, if any, and the subject of the request must be stated in full. If such information is missing, your information requests will not be met by MOMENTO. In case of inaccurate or incomplete information, MOMENTO does not accept any responsibility with regard to the fact that the request is not answered. In addition, we request that information and documents related to the subject be attached to the application.
